Can someone in Florida have charges brought against them if they were driving and involved in a accident. The friend was thrown from car because they was not wearing a seat belt, and both under the influence?

I wish to inform you that if the driver was drunk then he can be charged for DUI in Florida. The fine for first conviction is generally $250 to $500, community service 50 hours, probation 180 days, etc. If the person thrown out of the car was not wearing seat belt then the penalty is $30.

Your friend needs an attorney - NOW."If it ain't in writing, it never happened."

In Florida, the State has to prove that you were behind the wheel of the car or vehicle to prove you were DUI. If there is a wheel witness then you can face penalties such as a fine, court costs, community service, counseling, DUI classes, impoundment, and ignition interlock among other penalties.
