  • Pled Guilty Under False Info in MS

    I pled guilty to a drug charge after Sheriff told me I had been indicted on charges. I had not been. Arresting officer tried to drop charges, superior officer refused. I was informant for other county, my home county wouldn't listen to Investigator from the other county, he came to get me out when I was arrested, along with my former boss, a captain on the force. I was a former employee of both law agencies, I had left home county to work for other county.

    I wish to inform you that if you were informer of law enforcement agencies then you can take the plea that you had not committed any crime and contest to any charges being made against you. In this regard you can argue that in United States v. Oquendo, 490 F.2d 161 (5th Cir. 1974) it was held that a paid Government informer, could entrap accused, even though no Government officer knew of informer’s actions, because the Government is deemed to have constructive knowledge of such chicanery. Hence you can argue that government knew about your actions thus you should not be held liable. As regards your guilty plea you will have to request court that you intend to argue and contest the allegations.
