  • probation and bail - accused of threatening someone

if a person is out on bail and on probation and someone accuses them of verbally threating them.....does the person automatically go back to jail as a violation of probation?

re: probation and bail - accused of threatening someone

If it can be proven they threatened someone, it's possible, but we are supposed to have due process, which means it's the accuser's burden to prove their accusations. If a witness heard the exchange, it's possible. But in this day and age, and thank O.J. Simpson for this, a woman can cry wolf and every time judges listen and come to her rescue. It need not be the truth. Many a woman since the whole O.J. Ordeal have made false accusations against men, and given those men criminal records out of spite, when there was no danger to them.

The O.J. Simpson case catapulted the whole domestic violence/women seeking protective orders out of spite. Before that, there was no such thing as "domestic" violence, and if the police were called to your home, nobody would get arrested. In essence, they didn't really do much. Nowadays, it's the Gestapo.
