My friend and I were pulled over because I was going 72 in a 60. The officer smelled marijuana and called for back up. We were asked to vacate the car and placed under arrest due to the smell. We cooperated and told them where it was. There was less than 4 grams total found. Neither of us have ever been in trouble. My question relates to the likelyhood of getting deferred for this citation. I also am wondering if there is anyway to get the ticket dropped and the chances of that happening and if so will the possession charge be dismissed.

Make sure you get legal counsel (or at least the public defender) to try to keep this off your record eventually--jail time is probably not likely if your record is very clear now. But having that arrest and/or a conviction on your record will make job-hunting etc. more difficult. Often this could be negotiated down to some kind of court supervision etc. If it eventually appears it cannot be negotiated down, or you need to discuss this in more detail with senior counsel to review options etc., please let us know... -

nah dude you wont have to worry about **** in reality most states policy on possession is only a misdemeanor for anything under 6 grams so no worries just hold tight and dont get caught... also a key for keeping your car smellin clean use dryer sheets all day!Comment
