  • Canadian Assault Charges Law

    Arrested for assault and mischief. GF does not want to press charges however Ontario law in Canada states it is up to Crown Council. How do you go about lifting the no communication set out in the release terms. Girfriend is willing to communicate and write the officer in charge. She did not sign a written statment or have pictures taken and wants to help by attending counselling sessions. No prior arrests. Clean record. Looking for advice on the best way to communicate and still abide by release terms. How do I get this lifted. Please help.

    Try having each of you speak to the Crown prosecutor directly. They have the right to continue to pursue the case on their own (even if you don't want them to) but if they feel this was a one-time incident and will never happen again, they may and often will drop it. Offer to take counseling etc. if need be.

        Me n my girlfriend are having same problem we talked about it said its goin to far and decided to go counciling and couples treatment would that work to get charges dropped

          If the Crown is saying it went too far, they may be telling you that they intend to follow through with prosecution.

          Under the circumstances, counseling and couples therapy, as well as anger management, may be ordered by the court ANYWAY in order to prevent further incidents between the two of you. That alone probably isn't going to get the charges dropped, though.
