Not exactly...Normally any such confiscated property is subject to a hearing that allows the owner to show that proceeds of the drug trade etc. were not used to buy the house or facilitate the trade/crimes.

It's my understanding that after a drug related arrest, the house in which the arrest occurred would be seized by the federal government, and would not be returned to the owner, as the house itself is ajudged "guilty" and cannot prove itself innocent. True? This is assuming a DEA bust, but may apply to local authorities also.
I remember reading this interpretation some time ago, but cannot remember in what publication the info was found.Tags: None
