I subcontract to a small contracting company in Alberta and drive one of their vehicles with their equipment inside. I haven't been paid for almost 3 months and the amount owed has grown to just over $10k. I am at the point that I don't want to sub any more work until I get paid. The company is going to want their vehicle/equipment back - can I keep the vehicle and equipment in my possession until I am paid?

Re: Contractor hasn't paid subcontractor for 3 months
I wish to inform you that you may not keep vehicle or equipment as you do not have a lien. In this generally mechanic has a lien and if you can show that you have repaired vehicle then you can claim mechanic lien and keep vehicle. However as you are driving thus you may not keep vehicle unless there is something through which you can show that you have lien. Further you can file a lawsuit for breach of contract and demand amount back from other party.
