I recently sold a vehicle on ebay with a salvage title in which the owner picked up in person and now the new owner wants me to buy back the vehicle, pay for unforseen damage with the motor or he says he is taking me to court.
In the listing of the vehicle I had multiple photos of the damage and stated the following in red:
"Vehicle Condition: I have done my best to make every reasonalble effort to describe the vehicle to you as well as provide photo's that show the vehicle's condition, however, there could be unforeseen or undetectable damage." Also stated: "Warranty: This vehicle is being sold AS-IS, with no warranty expressed or implied with faults and an Indiana Salvage title."
The new owner could have purchased ebay's buyer protection program or had the vehicle inspected prior to purchase but did neither.
Can the new owner take me to court and win or is this a scare tactic?
