  • No contract signed but am I still liable?

    A company offered me a job and I was unable to take it. I did not sign a contract with them. Out of the blue they made a payment to me a month later for salary. I contacted them and advised them of the error then made arrangements to send the payment back in cash as I did not have a cheque account. A year on they are now disputing having ever received the payment and I no longer have proof of payment. They have called in a debt colection agency and are threatening court. What is my legal position? I am obviously reluctant to pay the monies out of my own pocket but see no other way now. I am furious as it was myself who contacted them to tell them of their error and the payment was totally unsolicited by me. Any ideas? Thank you.

    You may file a police report under penalty of perjury and criminal law sanctions--they are accusing you of theft...it does seem a little odd to send cash??
