Non-Solicitation of Customers or Prospective Customers. While I am employed by Noble and for a period ending 24 months after the date of termination of my employment with Noble for any reason, I will not, directly or indirectly, on my behalf or on behalf of any other Person, solicit or call upon any customer or Prospective Customer of Noble for the purpose of, or with the intention of, selling or providing to such customer or Prospective Customer any product or service in competition with any product or service sold or provided by Noble during the two-year period immediately preceding the termination of my employment with Noble; provided, however, that these restrictions shall only apply to customers or Prospective Customers of Noble whose dealings with Noble were, in whole or in part, initiated, coordinated, supervised or conducted by me while I was an employee of Noble.
My spouse got offered a job by a company that contracts with Noble for their hardware and call center software. He wants this position however the company came to him. they found his resume online. He did sign this form a few years back and still works for the company. Is he obligated since he wasn't part of the initiated? (last paragraph)
