    My brother has sold telephone services for a publicly traded company for 5 years and I too had a telemarketing business as well selling other types of products and my brother approached me Oct 2005 with the ability to sell telephone services for the same telephone company he was selling telephone services. Oct 2005, I started selling for this company with no contract whatsoever, I just received an email from general counsel atty from the telephone company about complaints received from past telemarketers stating that Verizon was going bankrupt, which it is not, the atty for the telephone co asked me not to make those types of remarks when selling or any reference to Verizon. The first day of selling, the president of the telephone co instructed my brother to provide me with scripts and rebuttals to use for selling their services. The sales materials he provided made direct references to Verizon, when I questioned my brother he said that the scripts were acceptable. After doing business with telephone co for about 9 months, in July 2006, an employee of several days contacted the local news station and advised them that my company was using unacceptable scripts. The News station contacted telephone co we were selling for and they fired my company stating that they do not condone any type of script that has any reference to Verizon in the script because it misleads customers and tarnishes their goodwill. The telephone co kept my last commissions check because they said they wouldnt pay for sales made with unacceptable scripts. A few weeks later, I lost my business, my family and I am sitting on a huge amount of debt and October 2006, my brother offers me a job at his telemarketing company as a sales supervisor. On my very first day I discover that his company was still using the same scripts, which I thought that he would be crazy for using thoe scripts that I lost my business over. I questioned him about the scripts and he said that the telephone company is fine with his company using the unacceptable scripts because his employees have more sales experience. But I told him that the atty for teephone co said those scripts are not acceptable, he still stated that they are acceptable and not to question him any further about it. I have worked there for 3 months and during that time I have tape recorded sales presentations of various sales representatives, made copies of training and sales floor scripts with references to Verizon and compiled a list of customers who called in complaining of that telemarketer that signed up customer mislead them. If my brother is right about the telephone co accepting those unacceptable scripts and has been using them for over 5 years. How do I proceed from here? Do I have a lawsuit, against who if any? Will there be any reprecussion from my wrongdoing if I bring this situation to light from the telephone co?

    You could ask your state attorney general's office to intervene, and call Verizon as well, and they may both assist you in tracking down what is happening.

    It would be hard to sue unless you can argue your brother and others misled you and have now caused you damages--you could perhaps at least sue for pay while you worked according to their improper instructions.
