  • Statue of Limitations/garnishment (California, Colorado)

I have received a summons to garnish my wages by a sheriff for a C/C debt beginning balance $1100 in 1999 in California. I haven't used the card since 1999, however in 2001 I believe I made a payment on the account. The credit card company that now owns this account is located in Colorado and is garnishing for 2,500 on the form it states that the judgement was entered in the court on 8/2/2005.

The credit card Co had offered to allow me to pay 50%.

    Should I take this offer?
What is the statue of limitations for this card in California or Colorado?

Will you tell me what my rights are regarding this case?

Thank you! I did already look at that page. It is helpful to know that the SOL is 4 yrs in CA so it looks like I may have a case.

      What is my next step?

      Who do I call?

Other people are saying to get an attorney, with the few attempts, I've made, the attorneys are telling me my settlement is too small at $2500.

I have until Monday to respond to this summons.

I don't know if I should take the 50% off and make payments?

Please help me with my next step?

Were you ever served court papers? Did you default?

I am going to file a claim of exemption.

Do I have a case pleading the satatute of limitations, or should I try to work something out with them.

Some clerks have said that the laws have changed, so what is my best option?

The exemption indeed will protect some personal property.
