  • Can anything be done? I had a truck financed thru Santander USA

    I had a truck financed thru Santander USA...We made a deal on a pmt schedule...I faxed the paperwork to them...they say they never got it and repoed my truck... 2 days ago I get an email saying they are willing to settle and send me my title for $1600...I said I would agree and would like to make arrangments to pick up the truck...I get another email today saying they messed up and do not have the title or truck...They keep doing things like this to me.

    Can anything be done?

    Can they just keep doing things like this...I know I faxed the paerwork...but they say they did not get it...I accepted an offer they made and now they say...Ooops we messed up.

    Does not seem right...but I have no money to hire lawyer and I am disabled and do not have a vehicle to go see one ro to pay a consultation fee.

    Any help would be appreciated.

    They do not have your truck. The repo agent has it. Your right to redeem varies based on your state. You have a short time frame to make arrangements to pay off the loan and redeem your vehicle.

    I would not be trying to provide information and knowledge if I did not sympathize.

    Some days it is just not worth chewing through the restraints to face life.

      I wish to inform you that you can claim compensation for breach of contract. As agency had informed you that they are ready to give title for $1600 and you had accepted thus a contract has been made between parties. If now other party cannot honor their contract hence they can be made liable for your losses under breach of contract.

        I am aware of this...but they keep making agreements and I accept them and agree to follow thru...but they for some reason keep breaking the agreements for one reason or another...like holding a carrot in front of you and then snatching it away...by saying Ooops or we lost it.

        Funny how when it is their fault...we have to accept it...but when our/my fault...oh well...such is life.

          Thank you for the reply...how would one pursue this?

          They keep doing this and it is not right...I make the agreements and try to follow thru but they keep making these offers and then yanking them away...crying foul for one reason or another.

            Contact your state Attorney General's Office, Consumer Protection Division. They look into and enforce violations of fair consumer practices.
