    My dauhgter was attending karate school with no contract. After 1 year the owner said he would not accept cash or checks anymore and was taking payment via EBT. He filled out a form with my information which I signed and he stated that it was for the bank so they could debit my account each month for $95.00 for 1 child. I received no paperwork from him. A few months done the road my older daughter joined the class. The owner and I did not discuss form of payment. I paid cash for that month. The next month he debited me for the $95.00 that I gave authorization for plus took out the addtional fee for the 2nd child which was not authorized by me. Within 2 months my older daughter dropped out and i gave him 1 months notice prior to billing. I was again charged for both kids ($170). He told me he would reimburse me the extra $75.00. I have yet to see nothing. But he did put the billing back to $95 the next month. I notified him last month that my younger daughter will no longer be going there because she has been ill. Because of my previous problem with his billing, i closed my checking account. Now I received a bill for nearly $300 from the billing company. When I called them, they told me that there is some kind of contract but they would have to request it from him. My question is : Was it illegal for him the remove funds from my account that was not authorized? And, not at any time when I signed did I read a contract or was informed of one. And how can I get my money back from him and what is my recourse? If it was taken out illegally would this void the contract.

    Based on what you say here, you could file suit against him (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered due to his behavior... You may also report him to your state attorney general's office.
