    My sister has a bird. She used to go to a college that taught animal training. While she attended school, she became very fond of a particular bird that she took care of. This bird had a few health problems and so the school was willing to send the bird off to live at what they refer as a retirement home for birds. This place turns out to be an unbudgeted and rundown facility, so my sister offers to give the bird a home. My sister during the past five months since she received the bird has taken very good care of him. She has returned him to good health and everybody involved agrees he is doing very well.

    However, my sister two and a half months after she received the bird she mentioned to the zoo that the bird needs to have a better home than she can provide. She has only room for one bird and she believes he is in need of a companion. She has spoken to the zoo and several other places about this. The zoo, took this as he has not adjusted well and has asked for the bird back. They want to send him to the retirement home for birds that I spoke of earlier. As you can imagine my sister is outraged. She has become even more attached to the bird over the past several months. She wants the bird to go to a place of her choosing or to remain as her property. Nevertheless, certainly not go to a run down facility that no animal should be sent.

    This is where the problem comes in. The zoo, being the type of people they are, created a contract. There are several items in this contract. I have listed the only important item, as the rest are not in question.

    Line 5. This donation is subject to a 3 month trial period. If the animal does not adjust well to his new environment, "Jane Doe" will return him and relinquish ownership to "Zoo

    The question that I have is who owns the bird?
    She has the bird after the trial period.
    The bird adjusted in my sister’s opinion.
    Who else’s opinion matters?
    The bird has seemed to gotten better even in the past month, and does not seem to be as lonely as he was before.
    Does that change anything?

      She has not given up ownership--they have to agree a solution or she can do as she wishes.
