Is it possible to get sued innocently?

  • Is it possible to get sued innocently?

    a friend is trying to sue me for her missing sunglasses and a damage to her car. she tried to blame it on me when i was drunk, and would not let me off her car even when i told her i was going to puke. she told me puke in the car, now she is trying to sue me for her missing sunglasses which is worth $200. i called 911 because they would not let me off and so i had to force myself off. the cops came and had a brief look of my room but they left as they did not have enough evidence. now she is threat texting me that she already sued me after the next day of the incident and 3 days after the incident, she says that i would need to show up at court on september 20th or else cops are going to come to arrest you. is she lying or is it possible to get enough false evidence within 3 days to sue someone? the incident happened in alberta. she lives in saskatchewan and im moving to BC in a week. if she does sue, and the court accepts, and i cannot attend the court of appeal, what will happen?

    Anyone can sue anyone for anything. It doesn't mean they have a good or that they'll win.

    When it comes to defending yourself, understand that your friend has the burden of proof. She must show sufficient evidence to convince a judge that you took her sunglasses and were responsible for the damages.

      If she sues you she will have to have you served with the summons and complaint. If you are not in the province, then the suit cannot go forward. As long as you have not been served, you cannot be required to come to court.
