    I live in CA but have a court case for personal injury car accident in Florida.
    The lawyer proposes taking 40% of the settlement or verdict.
    Does that seem reasonable?
    And he wants me to pay every 30 days for any expenses they have to incur outside of legal fees.
    He says that is usually not much but how do I know how that will work? I don't want any big bills?

    What do you mean proposes? Have you not already hired the lawyer? Signed a fee agreement?

    Typically it's 1/3 before trial and 40% if a trial is necessary.

    As for expenses you won't know how much they are until they are incurred. You won't know what kind of experts will have to be hired or what they will charge.

    It's unusual to pay as you go for expenses.

    Again, have you already hired this lawyer?

    If not, you can say no and find somebody else.

    If you've already hired him and you are just now discussing fees then you have made a big mistake.
