  • DO I HAVE TO SERVE THE SUBPOENA?

IF A DISTRICT ATTORNEY SERVES YOU WITH A SUBPOENA THAT IS NOT SIGNED BY A JUDGE BUT FROM THE CLERK OF JUDICIAL RECORDS, DO I HAVE TO SERVE THE SUBPOENA?

Re: DO I HAVE TO SERVE THE SUBPOENA?

Normally subpoenas are issued to call for some records and a judge's signature is not required. A signature of the clerk of judicial records is more than sufficient for issuing a subpoena. If you have not complied with the subpoena , they can seek the intervention of the court to issue a court order to produce the documents , which would of course have the judge's signature.

What do you mean do you have to serve it?

Do you mean obey it? or what is your role?
