    If a former lawyer who became Judge in a case that they were affiliated with lawyers who were prosecuting the case considered conflict of interest?

    If the judge happened to be a lawyer with the firm but had nothing to do with the case it shouldn't be a conflict. Provide more details.

      It can sometimes be if the lawyer has access to inside confidential information about the case.
      Simply the affiliation itself is normally not an issue.

      You can formally ask the judge to step down if you believe a conflict exists. He has to decide--on the record which can be appealed.

        Generally speaking a judge has a relationship almost all the attorneys in the area. Whether a conflict exists would likely depend on whether the judge had access to biased information beforehand.
        Due to a recent promotion, I should now be referred to as Major Obvious.

        I would not be trying to provide information and knowledge if I did not sympathize.

        Some days it is just not worth chewing through the restraints to face life.

          Very little chance he will recuse himself if he didn't already.

          It's normally not a conflict. Heck in some towns the judge knows all the people.

              Happens ALL the time and is almost always held to be legal and proper. Has to really be a clear and strong conflict to do otherwise. That's the judge of a judge to separate himself from the case and judge impartially.
