    My wife parked our vehicle at a Mcdonalds parking lot while she went inside. When she came out she noticed our vehicle had a taxi cab that had lost control on top of the hood compartment of our vehicle. She identified herself as the owner to the police who were on the scene. The driver of the taxi apologized stating that he was getting robbed at the time of the accident. The driver also stated that his insurance would take care of the damage.The police did not arrest anyone and no money was taken.The next day i reported it to my insurance company but was told because i only have liability coverage that i had to go after the taxi insurance on my own. I contacted the taxi insurance and was told i had to call back after they investigated. When i called back i was told because the driver said he was being robbed at the time that he may not be liable and that the insurance company may not be obligated to pay for the damages. What can i do? p.s. i live in NJ.

    You can sue him, his insurer and your insurer in small claims or other court if need be and let them fight it out as to which is liable.
